Criminalizing Attempted Crimes

Criminalizing Attempted Crimes

The criminal law is designed with a view to protecting the individual rights of the citizen and the health and well being of society as a cohesive unit. In this regard, it is responsible for setting the parameters of social conduct, and for ensuring consistent application of principle and doctrine across the board. One of the most controversial areas of the criminal law is undoubtedly its role in penalising criminal attempts. When one attempts criminal behaviour but does not complete it, should that person still be liable as a matter of public policy? What if a prospective criminal stops a second from shooting their victim, deciding not to follow through their criminal intent? Furthermore, should a criminal be penalised for trying to commit a crime that is factually impossible? In this article, we will consider each of these arguments and look at possible ways in which they could be more effective treated.

Criminal law usually concerns itself with punishing those who have committed wrongs against the person or against society, and this is generally very effective in ensuring a sense of lawful community and deterring the bulk of criminals in their actions. However, one of the most pertinent questions most legal systems face is when, if at all, to intervene in perfectly legal behaviour in aid to stop a crime from happening? Consider the example of a gunman looking to murder a close friend. He buys a firearm. Is he arrested at this point for attempted murder? He goes to a hill near his friend’s house with the gun. Here? He takes aim and begins to squeeze the trigger? How about now? It is very tough to interpret the most advantageous point to intervene in potentially criminal behaviour. On one hand there is the threat of encroaching on civil liberties, whilst on the other there is an obvious threat to life and life, as well as property. Drawing the line has been particularly hard in recent times, and has caused government draftsmen a number of headaches in interpreting what the law should be.

Consider next the scenario of the thief stealing from an empty pocket. Mentally and physically he has committed sufficient acts to be convicted of the crime, but simply because there was no wallet to be stolen, should he walk free? Because there was no wallet, he could never be convicted of theft, but should he be liable in attempt? The answer in most jurisdictions is yes, but again this presents further complications. Say for example, you have a would-be drug dealer who buys a quantity of paracetamol. He sells these in the mistaken belief they are illegal – he could never be convicted of supplying controlled drugs, but could he be convicted on the grounds of his attempts? Most jurisdictions again say yes, with the rationale that dangerous people should be stopped in their tracks. Although a fair point, this kind of argument does not sit well in a modern context, particularly where civil liberties and human rights play such a big role in law internationally.

Additionally, the concept of abandonment is somewhat of a mixed bag, with some countries swinging one way and others another. Should the accused be allowed to drop his gun at the last minute and decide not to kill on this occasion? Alternatively, is the fact that he considered and made steps towards perpetrating a serious crime sufficient to attract liability and attribute blame? Courts across the world are intensely divided over this issue, even internally, given its particular conundrum in context. What is certain is that the criminal law may feel obliged to intervene in certain circumstances to prevent harm to their citizen, which would surely be a significant consideration in mitigation for wrongful arrest.

The concept of the law of attempts is highly interesting, and of particular note is the specific treatment across the world of both abandonment and illegality. Perhaps in an era of greater harmonisation, we will see more international authority on the application of these principles. Peoria county

My Choice of the Best in WoW Gold Guides

on July 11th, 2009 by todaynet

Just about everyone who plays World of Warcraft is looking for the fastest, easiest way to make gold in the game. Unless you’re already a master of gold-making techniques, your best bet is to get your hands on a really good WoW gold guide.

OK, so you need to get yourself a gold guide. The question is: which of the many WoW gold guides is best?

I’ve found a simple answer: the best gold guide you’ll find is called the Massive Gold Blueprint, a surefire system developed by WoW gold guru Jonathan Kenins.

The best WoW gold guide is Jon Kenin’s Massive Gold Blueprint.

I’ve had amazing results by following Jon’s gold-making tips:

- I’ve got all the best flying mounts that I never thought I’d be able to afford
- I’m the most popular member of my guild, since I can always give extra gold to my guild-mates when they need it
- gems, flasks, potions, enchants, glyphs… I’ve got all the best buffs for my gear
- I never have to worry about scraping together the gold I need for upgrades
- I never worry any more about paying for the potions and flasks I need to get ready for my raid nights

By focusing on a small number of high-profit items to trade in the auction house, the MGB system lets you make enormous amounts of gold in very little time.

Let me list some of the most valuable techniques I’ve gotten from the MGB system:

- what items to buy, in order to make the most possible gold in the least amount of time
- how to make all the gold I need without learning professions, or even having any high level characters
- how to use the psychology of the auction house to gain an unfair advantage over other players, and make heaps of gold as a result
- how to avoid common mistakes that even experienced auction house players make every day (and lose gold opportunities as a result)

I have to say that using the MGB Blueprint methods is one of the most enjoyable ways you’ll ever find to improve your World of Warcraft experience. Grab a copy of this excellent WoW Gold Guide and start having more fun in Warcraft!

Planning a Family Ski Vacation

on July 8th, 2009 by brtideas

It’s time to plan the family vacation – and everyone wants to go skiing. Don’t worry, skiing isn’t as expensive as you might think, and there are numerous resorts that cater to families, offering a variety of Peoria hotels packages designed to save you money. The problem will be choosing the destination.

Most ski resorts have websites. Start the planning process by accessing these websites to determine where you and your family might want to go for your family ski vacation. There are many different things to look for when choosing a resort. The absolute most important thing to look for is a ski school if someone in your family will need instruction. While most resorts do have ski schools, some don’t. Don’t make the mistake of choosing a destination where one or more of your family members won’t have fun, imply because they don’t know how to ski.

Next, take a look at the Peoria hotels, slopes, lifts, and trails. You want to make sure that the resort has something to offer everyone in your family. If the resort only caters to beginners, an expert skier will become quickly bored. If you have a snowboarder in your group, and there is no snowboarding park or terrain, that snowboarder will not be happy. There are resorts that serve all winter sports – so make sure that your families interests are covered.
